These Terms and Conditions (“Terms”) govern your access to and use of the Dentist Nerds website (the “Site”) and any communications you exchange with Dentist Nerds, LLC (“Dentist Nerds,” “we,” “our,” or “us”), including email, phone, and text (SMS/MMS) messages. By using the Site, submitting a form, or communicating with us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to: (a) attempt to gain unauthorized access to the Site or related systems; (b) interfere with or disrupt the Site; (c) scrape, harvest, or collect data from the Site by automated means without our written permission; (d) upload or transmit malicious code; or (e) misrepresent your identity or affiliation.

2. Informational Purposes; No Guarantee of Results

Dentist Nerds is a dental marketing agency. Content on the Site, including case studies, examples, and performance figures, is provided for general informational purposes and reflects results achieved for specific clients under specific conditions. It is not a promise, guarantee, or prediction of the results you will achieve. Nothing on the Site is legal, medical, tax, or other professional advice.

3. Intellectual Property

The Site and all text, graphics, logos, images, video, and other content on it are owned by Dentist Nerds or its licensors and are protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, republish, or create derivative works from any part of the Site without our prior written consent.

4. Inquiries and Information You Submit

When you complete a form, request a demo, or otherwise contact us, you represent that the information you provide is accurate and that you are authorized to provide it. We use the information you submit to respond to your inquiry as described in our Privacy Policy.

5. SMS / Text Messaging Terms (A2P 10DLC)

This Section 5 describes how Dentist Nerds uses text messaging. Please read it carefully.

5.1 Consent and Opt-In. We send text messages only to people who have expressly opted in to receive them. You may opt in by checking the SMS consent box on a Dentist Nerds web form, by texting us first, or by giving us your mobile number and asking us to reply by text. Consent to receive text messages is not a condition of purchasing any product or service from us, and we will never add your number to a texting program on your behalf.

5.2 Purpose — Replies to Inquiries Only. Our text messages are conversational and informational. We use SMS solely to reply to inquiries you have initiated and to handle directly related follow-up, such as:

• Answering questions you submitted through a form, call, or email;
• Confirming, scheduling, or rescheduling a call, demo, or meeting;
• Sending information or links you specifically asked us to send;
• Following up on an open conversation you started.

We do not send marketing, promotional, or advertising text messages, and we do not run automated recurring campaigns, drip sequences, or bulk broadcasts.

5.3 Message Frequency. Message frequency varies and depends on your conversation with us. Because our messages are replies, you will generally receive messages only while an active conversation is in progress.

5.4 Message and Data Rates. Message and data rates may apply. You are responsible for any charges from your mobile carrier or plan.

5.5 Opt-Out. You can stop receiving text messages from us at any time by replying STOP to any message. We will send a single confirmation message and will not text you again unless you opt in again. You may also opt out by calling us at +1 (310) 592-6293.

5.6 Help. For help, reply HELP to any message from us, or call us at +1 (310) 592-6293.

5.7 Carriers and Delivery. Mobile carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier and device and is not guaranteed. Supported carriers may change without notice.

5.8 Privacy of Your Mobile Information. No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors that provide support services to us, such as customer service and messaging platforms, solely so that we can reply to you. All other use categories exclude text messaging originator opt-in data and consent, and that information will not be shared with any third parties. See our Privacy Policy for details.

5.9 Eligibility. You must be at least 18 years old and the owner or authorized user of the mobile number you provide.

6. Third-Party Links and Services

The Site may link to third-party websites, tools, or services that we do not control. We are not responsible for their content, terms, or privacy practices. Your use of a third-party site or service is governed by that party’s terms.

7. Client Engagements

If you engage Dentist Nerds as a client, the services we provide are governed by our Terms of Service and any applicable order form or written agreement. In the event of a conflict between those documents and these Terms, those documents control with respect to the services.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DENTIST NERDS, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THESE TERMS.

10. Indemnification

You agree to indemnify and hold harmless Dentist Nerds, LLC from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your breach of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and the “Last Updated” date above will be revised. Your continued use of the Site after that date constitutes acceptance of the updated Terms.
